'Australian data residency' doesn't mean what you think — where the big AI assistants really stand

"Australian data residency" is fast becoming the headline feature AI vendors wave at nervous local buyers. It sounds decisive. It often isn't — because the phrase hides a distinction that decides whether it actually solves your problem.

The distinction that matters: at rest vs in flight

There are two very different things a vendor can mean.

  • Data at rest — where your saved data lives: your conversation history, uploaded files, custom assistants. Stored "in Australia" means those records sit on Australian servers.
  • Data in inference — where the actual thinking happens the moment you hit send. Your prompt has to be processed somewhere, and that somewhere is frequently the United States, even when your stored data is "in Australia."

A vendor can truthfully claim "Australian data residency" while every prompt you type still travels to the US to be answered. For a business under the Privacy Act, or one handling client-confidential material, that gap is the whole ball game.

Where the big three actually stand

  • ChatGPT (OpenAI). Australia is now a listed region for data at rest on Enterprise, Edu, Healthcare and API tiers. But inference still defaults to US infrastructure — and the residency option doesn't cover the consumer Plus, Go or Free plans most people use. Read it as: storage can be local; the processing isn't.
  • Claude (Anthropic). Following Anthropic's Sydney launch, Claude inference can now run in the AWS Sydney region — closer to genuine onshore processing — though that's typically an enterprise/API configuration, not a consumer toggle. The most complete onshore story of the three, with caveats to confirm.
  • Gemini (Google). Google operates two Australian data centres (Sydney and Melbourne) and holds IRAP certification, with AUD-native billing. For an Australian buyer on a standard plan, it remains the strongest off-the-shelf local fit.

What it means for Australian businesses

Don't buy on the phrase — buy on the specifics. Before you trust any "Australian data residency" claim, ask the vendor three questions: Does it cover my plan, or only enterprise? Does it cover inference, or only storage at rest? And what about the add-ons — web search, file connectors, third-party integrations — which often process data offshore regardless of the headline.

Does it change our scores?

It's exactly the kind of detail our Australian Fit criterion exists to capture — and why it's weighted the way it is. A tool that stores data locally but thinks about it offshore is not the same as one that keeps the whole transaction onshore, and we score them differently. We'll reflect these moves as they're confirmed across our Claude, ChatGPT and Gemini reviews. For the head-to-head, see ChatGPT vs Gemini, and our Methodology for how Australian Fit is scored.

Frequently asked questions

What does "Australian data residency" actually mean?

Two different things. Data at rest is where your saved conversations and files live; data in inference is where your prompt is processed the moment you hit send. A vendor can store data in Australia while still processing every prompt in the US.

Do ChatGPT, Claude and Gemini process Australian data onshore?

Partly. ChatGPT lists Australia for data at rest on enterprise tiers, but inference still defaults to US infrastructure. Claude inference can run in AWS Sydney, typically enterprise/API only. Gemini has two Australian data centres and IRAP certification — the strongest off-the-shelf local fit.

Does residency cover the consumer plans most people use?

Usually not. The residency options above are largely enterprise or API configurations, not toggles on consumer Plus, Go or Free plans. Confirm your specific plan before relying on any residency claim.

What should an Australian business ask before trusting a residency claim?

Three questions: does it cover my plan or only enterprise; does it cover inference or only storage; and what about add-ons like web search, file connectors and integrations, which often process data offshore regardless.
