> **TL;DR:** From 30 October 2026, Meta's business terms let it crawl websites associated with your business and put the risk of its AI features on you.

**Posted:** 25 October 2026 · **By Adam** · **Category:** AI Assistants & Chatbots

## What changed

Meta's updated Commercial Terms "will come into effect on 30 October 2026", replacing the 6 March 2024 version. We read both on 23 October 2026.

Four changes stand out:

- **Automated access to your website.** You authorise Meta to "use automated software (such as web scrapers, bots, robots, spiders, crawlers and user agents)" and "create test credentials" on domains "associated with your products or services", or made available through your or users' use of Meta's products. Purposes include to "provide, develop, improve, research and maintain" Meta's ads and business products. The current terms have no such clause.
- **AI features at your risk.** A new AI Features clause says AI features "may make mistakes". You assume "any and all risks" of those features and their output, and must not remove AI watermarks.
- **An Australian clause.** If you are a small business and "reside, or your business is located in Australia", Australian law applies to your claims against Meta and Australian courts can hear them. The terms do not define small business. The current terms send claims from outside the US to courts in California or Ireland.
- **Notice of changes.** Meta now commits to at least 30 days' notice of material changes, except for safety, security or legal changes.

## Who it covers

Any business use of Meta's products: ads, Pages, catalogues, Ads Manager, Meta Business Suite and measurement. Supplemental terms cover Business Agents and the Meta AI business assistant.

## Why it matters for Australians

The OAIC's AI products guidance, updated 17 January 2025, says privacy obligations apply to personal information put into an AI system and to output containing it. It says due diligence is not "set and forget". Treat the Meta AI business assistant like any other AI product.

## What to do before 30 October

1. Read the new terms and any AI supplemental terms.
2. Review what your public pages expose. The terms do not say whether Meta honours robots.txt.
3. Set a rule for staff: no customer personal information in Meta AI tools, and a human checks AI-generated ads before they run.
4. Save a dated copy of both versions.

## Does this change our recommendation?

No. Our [Meta AI review](https://www.theaidirectory.com.au/review-meta-ai-australia-2026/) stands. The new terms place AI-output risk on the business. The terms also say small businesses keep statutory rights that cannot be excluded in some countries.

This is general information, not legal advice.
