> **TL;DR:** A US class action claims Claude's Max plans deliver far less than the advertised five or twenty times Pro's usage. Nothing is proven. Anthropic has moved to dismiss, with a hearing on 6 November. Australians are outside the proposed class, and our Claude scores stand.

## What changed

On 14 June 2026, Karl Kahn filed a proposed class action against Anthropic. The court is the US District Court for the Northern District of California (*Kahn v. Anthropic PBC*, 3:26-cv-05763). These are allegations, not findings.

The complaint says Max 5x (US$100 a month) delivers about 3.5 times Pro's usage, not five. It says Max 20x (US$200) delivers six to eight times, not twenty, and that its "Save 50%" claim is false. It brings five claims under California law, including false advertising, negligent misrepresentation and breach of contract.

On 19 August, Anthropic moved to dismiss the amended complaint. Its argument: the promise is five or twenty times more usage *per five-hour session*, and weekly limits are separate and disclosed. Anthropic's pricing page says Max gives "5x or 20x more usage per 5-hour session than Pro". The motion is set for hearing on 6 November 2026.

## Why it matters for Australians

The proposed class is "natural persons in the United States". Australian subscribers are not in it.

The question it raises still applies here. Anthropic charges Australians in Australian dollars: Max from A$170.01 a month, GST included, when we read the page on 19 September. At that price you should know what "5x" buys. It is per session. A separate weekly cap can stop you sooner. If you are weighing Max, test Pro's limits against your real workload first.

## Does this change our recommendation?

No. A complaint is not evidence, and we do not move scores on one. Our [Claude review](https://www.theaidirectory.com.au/claude-ai-review-australia/) (21/25) and [Claude Code review](https://www.theaidirectory.com.au/claude-code-review-australia-2026/) (20/25) stand. The Claude review already calls the jump from Pro to Max steep, and says most Australians won't need Max. Pro remains our recommended entry point. We will revisit both reviews after the 6 November hearing.
